Terms of Service

Welcome to FoloMoney! These Terms of Service (“Terms”) govern your use of the FoloMoney mobile application (the “App”), website at www.folomoney.com (the “Website”), and all related services (collectively, the “Services”) provided by FoloMoney Technologies Ltd. (“FoloMoney”, “we”, “us”, or “our”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By creating an account, downloading the App, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and FoloMoney.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from using our Services under applicable laws
  • Provide accurate and complete information during registration
  • Maintain and update your information to keep it accurate and complete

3. Account Registration and Security

3.1 Account Creation

To access certain features of our Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. FoloMoney will not be liable for any loss or damage arising from your failure to protect your account information.

4. Services Description

FoloMoney provides digital financial services including but not limited to:

  • Virtual USD card services for global spending
  • Money transfer and remittance services
  • Digital wallet services
  • Currency exchange services
  • Credit score monitoring and financial insights
  • Loan and credit services (subject to approval)

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time with or without notice.

5. User Obligations and Prohibited Conduct

5.1 Permitted Use

You agree to use our Services only for lawful purposes and in accordance with these Terms.

5.2 Prohibited Activities

You agree NOT to:

  • Use our Services for any illegal or unauthorized purpose
  • Violate any applicable laws, regulations, or third-party rights
  • Engage in fraudulent, deceptive, or misleading activities
  • Attempt to gain unauthorized access to our systems or user accounts
  • Transmit viruses, malware, or other harmful code
  • Interfere with or disrupt the integrity or performance of our Services
  • Use our Services for money laundering, terrorist financing, or other illegal financial activities
  • Create multiple accounts to circumvent our policies
  • Scrape, copy, or monitor any portion of our Services without permission
  • Impersonate any person or entity or misrepresent your affiliation

6. Financial Services Terms

6.1 Transactions

All financial transactions conducted through our Services are subject to:

  • Verification of your identity and account information
  • Compliance with anti-money laundering (AML) and know-your-customer (KYC) requirements
  • Transaction limits and fees as disclosed in the App
  • Processing times that may vary based on the type of transaction

6.2 Fees and Charges

You agree to pay all applicable fees associated with your use of our Services. Fee information is available in the App and on our Website. We reserve the right to change our fees at any time with advance notice.

6.3 Currency Exchange

Exchange rates are determined by FoloMoney and may differ from interbank rates. Rates may fluctuate and are subject to change without notice.

6.4 Loan Services

If you apply for and receive a loan through our Services:

  • You agree to repay the loan according to the agreed terms
  • Interest rates and repayment terms will be clearly disclosed before acceptance
  • Failure to repay may result in late fees, negative credit reporting, and collection activities
  • We may report your payment history to credit bureaus

7. Virtual Card Services

When using our virtual USD card services:

  • Cards are issued in partnership with licensed financial institutions
  • You must comply with all card network rules and regulations
  • Lost or stolen cards must be reported immediately
  • We may suspend or terminate your card for security or compliance reasons
  • Certain merchants or transaction types may be restricted

8. Verification and Compliance

We are required by law to verify your identity. You agree to:

  • Provide valid identification documents when requested
  • Undergo identity verification processes
  • Allow us to conduct background checks as necessary
  • Comply with all AML, KYC, and counter-terrorism financing regulations

We may refuse service, suspend accounts, or terminate relationships if we cannot verify your identity or if we suspect illegal activity.

9. Intellectual Property Rights

9.1 Our Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the exclusive property of FoloMoney or its licensors and are protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes in accordance with these Terms.

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our data practices as described in the Privacy Policy.

11. Third-Party Services and Links

Our Services may contain links to third-party websites, services, or applications. We are not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with third parties are solely between you and them.

12. Disclaimers and Limitations of Liability

12.1 Service Availability

While we strive to provide reliable Services, we do not guarantee that our Services will be uninterrupted, timely, secure, or error-free. We may suspend or restrict access to our Services for maintenance, updates, or other reasons.

12.2 “AS IS” Basis

OUR SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOLOMONEY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use our Services
  • Unauthorized access to or alteration of your transmissions or data
  • Statements or conduct of any third party on our Services
  • Any other matter relating to our Services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO FOLOMONEY IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

13. Indemnification

You agree to indemnify, defend, and hold harmless FoloMoney, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:

  • Your use or misuse of our Services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting us at support@folomoney.com or through the account settings in the App. You will remain liable for all transactions and obligations incurred prior to termination.

14.2 Termination by Us

We may suspend or terminate your account and access to our Services immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Fraudulent or illegal activity
  • Extended periods of inactivity
  • Requests by law enforcement or regulatory authorities
  • Technical or security issues

14.3 Effect of Termination

Upon termination, your right to use our Services will immediately cease. We may delete your account and all associated data. You remain responsible for any outstanding obligations, including fees and loan repayments.

15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

15.2 Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or our Services:

  • You agree to first contact us at support@folomoney.com to attempt to resolve the dispute informally
  • If the dispute cannot be resolved informally within 30 days, either party may initiate formal proceedings
  • Any legal action shall be brought exclusively in the courts of Kenya

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

  • Posting the updated Terms on our Website and App
  • Updating the “Last Updated” date at the top of these Terms
  • Sending you an email or in-app notification (for significant changes)

Your continued use of our Services after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must discontinue use of our Services.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us, constitute the entire agreement between you and FoloMoney regarding our Services.

17.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

17.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

17.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
